In April 2018, a metallurgical company and a road and bridge company signed the ''Highway Engineering Professional Construction Subcontracting Contract''. The contract stipulates that the metallurgical company will contract the tunnel project of a highway project to a road and bridge company, and a road and bridge company will The overall project is subcontracted to a tunnel engineering company for construction, and the project price is 322780881 yuan. A tunnel engineering company purchased construction machinery and construction materials and organized personnel to carry out construction according to the agreement. After a road and bridge company entered bankruptcy liquidation, the metallurgical company terminated its contract with a road and bridge company, which prevented the normal allocation of construction progress funds from a tunnel company. A tunnel engineering company sued a metallurgical company and a road and bridge company to the court as actual constructors, demanding the metallurgical company to pay more than 4700 million yuan for the project.
