Brief of the case
In 2019, the store operated by Liu was preserved by Luzhou XX for selling counterfeit drinks. In 2021, Luzhou XX Company sued Liu to Kunming Intermediate People's Court on the grounds that Liu infringed on trademark rights. Lawyers Zheng Yun and Li Qing represented Luzhou XX Company in the lawsuit. In the lawsuit, Liu provided a "receipt of receipt" with such and such a firm in 2019, after which the court found that the legal source of Liu's claim was established and ruled that he was not liable for compensation. Luzhou XXX Company appealed to the Yunnan Provincial Higher People's Court, arguing that the authenticity of the receipt could not be verified, and that the liquor corresponding to the receipt did not correspond to the preserved liquor label and was not the same batch of products. The second instance revised Liu to stop the infringement, and the refrigerator Luzhou XXX company compensated for the loss and reasonable expenses.
Referee Summary
The court of second instance held that, first, in this case, apart from submitting a receipt, Liu had no other evidence to support the real existence of the transaction, and Liu's factual claim that he bought two pieces of liquor from a firm was insufficient. Second, even if it is true that Liu bought two pieces of liquor from a firm, this fact does not mean that the infringing goods sold by Liu in this case are one of the two bottles of liquor stated in the receipt submitted. In this case, the box code information displayed on the packaging box of the bottle of liquor sold by Liu mou cannot correspond to the anti-fake box code information of the containing liquor queried according to the box code information uploaded in the receipt of the receipt of the company.
